HBO star Thomas Middleditch, 38, has split from his wife Mollie Gates months after revealing that they were swingers.
Mollie decided to file legal paperwork to end their marriage on May 28 but their separation date is noted as May 22.
It is stated that the costume designer and Silicone Valley star have ended their union due to irreconcilable differences.
Canadian Mollie is seeking spousal support from Thomas - who she wed in 2015 - People reports.
Only nine months ago Thomas, who played Richard Hendricks for five years in the American series, boasted in an interview with Playboy magazine that the couple had an open marriage and engaged in swinging - and that it was the reason that their partnership thrived.
Swinging is defined as the practice of engaging in group sex or the swapping of sexual partners within a group on a regular basis.
During the chat with the iconic magazine - which was originally founded by the late Hugh Hefner in 1953 - Emmy Award nominee Tom shared that he told Mollie to "get non-traditional" shortly after they tied the knot.
Middleditch told: "To her credit, instead of saying 'F*** you, I’m out,' she was like, 'Let’s figure this out.'
He then openly admitted: "To be honest, swinging has saved our marriage.
"We have different speeds, and we argue over it constantly, but it’s better than feeling unheard and alone and that you have to scurry in the shadows.
"I’m sexual. I’d always thought I was a romantic and that when I fall in love, that stuff fades away. It does for some years—enough to be like, 'I should get married, and I’ll be different.'
"But it’s part of me. If that’s part of your being and it feels important to you, find a way to explore it, because repression sucks."
He added that he and Mollie had a set of rules for their sex lives, telling: "Mollie and I have created our own rules, and compared to most of the people we’ve met who do this kind of s***, our rules are strict. We’re not off on our own; we’re together, a unit."
Shortly after the interview was published Thomas told of his regret of speaking so openly about his and Mollie's private life.
"To be honest, it’s a thing I wish I could take back. It was poor execution. But I’ve learned to keep things a little more close to the chest," he told Daily Beast.
