Northern Territory Man who raped a stripper with a beer bottle during a sex show appeals conviction

A self-confessed 'larrikin' who raped a stripper during a 'triple X dildo show' at a bucks party has appealed his conviction, claiming he believed the victim consented.

Kevin Glenn Willcocks, 41, put the neck of the bottle into the woman's vagina during the show in Girraween, in the Northern Territory, in June 2017. 

Willcocks was sentenced to at least nine months behind bars before being released on a suspended sentence last November.

He is now appealing his conviction, arguing he was under the impression he had the woman's consent, NT News reports. 

His lawyer Tim Game SC argued the woman allowed other men at the bucks night to insert a dildo into her vagina in the moments before Willcocks raped her with the bottle. 

'It's a very special case this because a moment before, there is consensual sexual activity, there is consent to the sexual intercourse involving the dildo, so at that moment he has a state of mind of belief in consent,' he told the court.

'The question is whether or not the Crown can prove that in that moment the state of mind changed.'

Mr Game said his client is a 'larrikin' who acted under a 'dreadful misapprehension'. 

'It's saying if you were acting under a mistaken belief as to what was happening or you were ignorant of things that were happening then you are not criminally liable,' he said.

Director of Public Prosecutions Jack Karczewski QC said Willcocks should have known there was a risk he didn't have the woman's consent. 

Mr Karczewski said juries in this day and age recognise that sex workers are also entitled to the full protection of the law.   

The Court of Criminal Appeal judges will hand down their decision at a later date.
