A 29-year-old dad has been charged after his 2-year-old son found his gun and shot himself.
Tommy Smith III was picking up his girlfriend last Saturday in Milwaukee, Wisconsin with his child in the backseat when the father ‘heard a gun go off’, according to a police complaint.
Smith turned around and saw his son had been struck by the round, and claimed his son ‘must have located the gun and discharged the firearm’.
Smith’s girlfriend admitted to police that Smith instructed her to ‘get rid of the handgun’ after dropping off Smith and his son at the hospital.
She led police to a garbage can where the complaint said the gun was found wrapped in a blue bandana.
‘[Smith] often drives around with a gun in his lap,’ Smith’s girlfriend said.
The child was also not in a safety seat while Smith was driving, ‘nor was the child restrained in any way’, the complaint said.
Smith allegedly stole the gun from the boyfriend of the child’s mother, and had previously kept the gun in the car’s cargo compartment.
The child remains in critical condition, and it is not known if the child will survive.
Smith now faces one charge of neglected a child and made his initial court appearance on Wednesday.
